CONDITIONS OF PATIENT AND PROXY USE


I. Introduction


This web site and related services are provided by Lindner Center of HOPE subject to compliance with the terms and conditions set forth herein. "Lindner Center of HOPE" includes the Lindner Center of HOPE, Lindner Center of HOPE Professional Associates, and provider practices affiliated with Lindner Center of HOPE. Please read the following information carefully. If you do not agree to be bound by these terms and conditions, promptly exit this Site.

Lindner Center of HOPE is pleased to offer you access to medical and behavioral health information via a web-based version of our computer charting system called MyChart. If you have any questions about the content contained in the MyChart account, please contact your provider.

These Terms & Conditions outline Lindner Center of HOPE's practices regarding MyChart information access and Lindner Center of HOPE's sensitivity to the right to privacy. By accessing a MyChart account, you confirm that you have read these Terms & Conditions and agree to be bound by them. Lindner Center of HOPE may revoke access to MyChart at any time for any reason.

II. Urgent Matters

You should never use MyChart for urgent matters. For all urgent matters, please contact a physician's office by telephone, go to an emergency room or dial 9-1-1.

III. Information Does Not Constitute Medical Advice and

Behavioral Health Advice

Lindner Center of HOPE assumes no responsibility for how you use the information you obtain from this Site. You should consult with your physician or other behavioral health care providers regarding your own condition and how this Site content may or may not apply to you.

Neither MyChart nor any other application available through this Site is a substitute for appropriate and timely contact with your provider. This Site is not a substitute for consultation with your provider. You should never change or stop any course of treatment/therapy prescribed by your provider without first consulting him or her.

IV. Access And Proxies

If Linder Center of HOPE grants a parent, legal guardian or other adult access to a patient's MyChart account, such parent, legal guardian or other adult is considered a "proxy" and a MyChart account may be activated for both the proxy and the patient.

MINOR PROXY AND MINOR ACOUNT ACCESS

For minor patients under the age of 13 years, Lindner Center of HOPE requires that a parent or legal guardian complete the MyChart Sign-Up Form for Child(ren) before it will grant access to the minor's MyChart account.

For minor patients between the ages of 13 and 18, Lindner Center of HOPE requires that the minor patient sign the MyChart Proxy Form & Patient Authorization to Release Protected Health Information to Proxy and the parent or legal guardian must also sign the MyChart Proxy Form before Linder Center of HOPE will allow a parent or legal guardian to have proxy access. If the patient revokes his or her assent, Linder Center of HOPE will terminate access for the proxy. Once the patient reaches age 18, proxy access will automatically terminate.

In addition to parent and legal guardian access to a minor patient's MyChart account, Linder Center of HOPE allows patients age 13 and older to access his or her own medical and behavioral health information through an account with MyChart. Linder Center of HOPE does this to encourage mature teenagers to have access to information regarding their medical and behavioral health care.

ADULT LEGAL GUARDIANSHIP PROXY ACCOUNT

For adult patients, Linder Center of HOPE will also grant proxy access to other adults. Linder Center of HOPE requires that the adult patient sign the MyChart Proxy Form & Patient Authorization to Release Protected Health Information to Proxy and the adult proxy must also sign the MyChart Proxy Form before Linder Center of HOPE will create the proxy access.

For patients who are deemed incompetent or incapacitated, Linder Center of HOPE will grant MyChart access to an adult who has an appropriate legal relationship with the patient. Linder Center of HOPE requires the adult requesting access to submit copies of the guardianship or power of attorney documentation proving the legal relationship with the patient before access to the patient's MyChart will be granted.

TERMINATION OF PROXY ACCOUNT

If any proxy's legal relationship with the patient changes, the proxy must (and the patient may) inform Linder Center of HOPE immediately by calling Linder Center of HOPE at (513) 536-0570 or sending written notice to Linder Center of HOPE at: Lindner Center of HOPE, Attn: MyChart HIM Department, 4075 Old Western Row Rd, Mason, OH 45040.

V. Security And Confidentiality

Linder Center of HOPE affords the same degree of confidentiality to medical and behavioral health information stored on MyChart as is given to medical and behavioral health information stored by Linder Center of HOPE in any other medium. Linder Center of HOPE is committed to protecting the confidentiality of your medical and behavioral health information. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. Linder Center of HOPE shall identify the records released and note the time and date of access each time a patient accesses MyChart. Linder Center of HOPE has taken steps to make all information received from our online visitors secure against unauthorized access and use.

For other than general information viewing, MyChart must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater).  Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals.  You can tell whether you are truly connected to Linder Center of HOPE by viewing the digital certificate.  This certificate verifies the connection between Linder Center of HOPE server's public key and the server's identification.

User names and passwords provide two layers of authentication and are stored in an encrypted database that is isolated from the Internet.  As a MyChart user, your role in maintaining the security of your medical and behavioral health information is: (1) changing your password on a regular basis, and (2) keeping your MyChart login name and password confidential.

You understand that no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. When you access a MyChart account, information will be transmitted over a medium that is beyond Linder Center of HOPE’s control. YOU HEREBY EXPRESSLY ASSUME THE SOLE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once the information is received by Linder Center of HOPE, medical and behavioral health information will be treated as confidential and given the same protection that all other Linder Center of HOPE medical records are given.

VI. MyChart Personal Login And Password

To initially enroll in MyChart, Linder Center of HOPE provides you with an access code which you use to create a personal login name and a password.  Once this access code has been used, it is no longer valid.  It is extremely important that you keep your login name and password completely confidential.  Anyone with access to your login name and password will be able to access the same confidential medical and behavioral health information you can.  That person will also be able to read your messages and send new messages as if they were you.  It is your responsibility to prevent disclosure of your login and password and to change your password if you feel that your security has been compromised. You may change your password at any time.

You understand and agree that Linder Center of HOPE takes no responsibility for and disclaims any and all liability for damages arising from a breach of medical record confidentiality resulting from your sharing or losing your password.  If Linder Center of HOPE discovers that you have inappropriately shared your password or that you may have misused or abused your access privileges in any way, access to MyChart may be terminated immediately.

VII. Response To Electronic Communication

Linder Center of HOPE will use reasonable effort to provide a timely response to electronic inquiries.  You should allow at least three (3) business days for a response.  If the Linder Center of HOPE provider is out of the office or unavailable, messages sent via MyChart may be routed to other authorized caregivers within Linder Center of HOPE for a timely response to your request.  With respect to any electronic communication, Linder Center of HOPE is only able to respond to such communications based on the information you provide.  If the information is insufficient, Linder Center of HOPE will be unable to provide accurate and reliable services.

VIII. Email Privacy

All communications between you and Linder Center of HOPE using MyChart occur over a secure connection.  You will, however, receive internet email messages notifying you that new information is available in your MyChart account.  These email messages will not contain any confidential medical information.  However, any person with access to your email account will be able to see this notification.  This can include you, your spouse, employer or anyone else that can access your email account.  You should take this into account when providing an email address. You are responsible for providing the correct email address for yourself and any Proxies. We are not responsible for the possible compromise of protected health information sent via encrypted email to incorrect email addresses you have provided.

IX. Your Responsibilities

You agree that MyChart is a communication service offered as a convenience to you.  You understand that it provides you with online access to portions of an electronic medical record and that you, and you alone, are responsible for any information that you intentionally or unintentionally communicate to others.  You understand that messages will be routed to the appropriate Linder Center of HOPE department as necessary for handling, and therefore Lindner Center of HOPE employees, other than the behavioral health provider who typically works with you or the patient for whom you have proxy access may be involved in addressing your request.  Therefore use of the MyChart account may not be appropriate if there is sensitive information that you would only wish to discuss directly with a particular medical provider.  You understand that entries you make using MyChart may become part of the medical record.

You understand that you may not transmit any information or message that contains unlawful, threatening, fraudulent, libelous, defamatory, obscene or abusive information or language. MyChart may not be used for any illegal or unethical activities.  Hacking, attempted access or other forms of inappropriate access or attempted access to unauthorized areas or information on this Site will lead to termination of use and potential legal prosecution.

X. Web Site Links

Linder Center of HOPE may offer links to related medical websites not managed by Linder Center of HOPE.  These website links are for informational purposes only.  Linder Center of HOPE does not endorse and has not verified the accuracy of the information in/on these websites, and you should not rely on any of the information found on the websites for purposes of treatment or diagnosis.

XI. Scope, Accuracy and Integrity of Information

The MyChart account to which you have access may not contain all of a patient’s medical and behavioral heath information and you agree to access such account knowing that it may be incomplete.
Although Linder Center of HOPE attempts to ensure the integrity of the Site, it makes no guarantees whatsoever as to the correctness or accuracy of the Site.  It is possible that the Site could include typographical errors, inaccuracies or other errors.  In the event that you identify an error or inaccuracy, please inform Linder Center of HOPE so that it can be corrected.  Information contained on the Site may be changed or updated without notice.

XII. No Warranties

This Site and the content contained herein are provided by Linder Center of HOPE on an "As Is" basis.  Linder Center of HOPE makes no representations or warranties of any kind express or implied as to the operation of its sites, or the content, products and/or services included therein.  To the fullest extent permissible by applicable law, Linder Center of HOPE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND/OR INFRINGEMENT.

XIII. Limitation of Liability

Some of the material on this Site is provided by third parties and Linder Center of HOPE shall not be held responsible for any such third-party material.  Linder Center of HOPE disclaims any responsibility for, or liability related to, such third-party material.  Any questions complaints or claims related to any product should be directed to the appropriate third party.

XIV. General

By using this Site, you agree that the laws of the state of Ohio, without regard to principles of conflict of laws, will govern these Terms and Conditions of Use and any dispute that might arise between you and Linder Center of HOPE and/or its officers, directors, doctors, nurses, therapists, staff, employees or affiliates.  You expressly agree that the exclusive jurisdiction for any dispute with Linder Center of HOPE and/or its officers, directors, doctors, nurses, therapists, staff, employees or affiliates will be in the courts of Warren County, Ohio and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Warren County, Ohio in connection with any claim involving Linder Center of HOPE and/or its officers, directors, doctors, nurses, therapists, staff, employees or affiliates.  Use of this Site is unauthorized in any jurisdiction that does not give effect to the terms and conditions set forth herein.

Linder Center of HOPE may modify these Terms and Conditions of Use at any time.
